Terms & Conditions Policy

Company Information: ALTGYM PRIVATE LIMITED (hereinafter "ALTGYM", "we", "us", or "the Company") is a private limited company incorporated under the laws of India, with its registered office located at 126-49/8, Bhavani Nagar, Gorantla, Guntur – 522034, Andhra Pradesh. These Terms and Conditions (the "Terms") govern your access to and use of ALTGYM's mobile and web application ZymHop (collectively, the "Platform"), as well as any products or services offered through the Platform (the "Services"). By accessing or using the Platform and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Acceptance of Terms: You agree that you are deemed to have accepted these Terms at the moment you register for an Account, click an "I Agree" checkbox, make a payment, or otherwise use any aspect of the Services. Your use of the Services is conditioned on your acceptance of all Terms herein. If you do not agree with any provision of these Terms, you must immediately cease using the Platform and Services. ALTGYM reserves the right to modify these Terms at any time (see Section 12 below). It is your responsibility to review the Terms regularly for any changes; continued use of the Services after any update signifies your acceptance of the revised Terms.

• Registration Information: You must register using your true identity. We reserve the right to suspend or terminate any Account if we suspect falsification of information or multiple registrations for abusive purposes. You may not share your Account with others or allow others to use your login credentials; doing so will result in immediate suspension or termination of your Account.
• Account Security: Keep your password secure. Do not write it down or reveal it to anyone. You agree to log out when you finish using the Platform, especially on shared devices. Any breach of security must be reported to ALTGYM without delay. ALTGYM is not responsible for any loss or damage arising from your failure to protect your Account.
• Single User Account: Each Account is for one individual only. An Account is non-transferable. You agree that only you will access and use your Account. ALTGYM may terminate an Account if it detects account sharing or unauthorized use.
• Age and Eligibility Confirmation: By registering, you confirm that you meet all eligibility requirements (e.g., age, residency) to use the Services. Parents or guardians should monitor any minors under their care if they attempt to use the Services (ALTGYM reserves the right to refuse access to any minor).
• Account Termination by User: You may close or deactivate your Account at any time by following the procedures in your profile or contacting customer support. Closing your Account will terminate your access to the Services, subject to any provisions concerning outstanding payments or prepaid amounts (see Section 4 on cancellations).

ALTGYM operates a digital platform that connects Users with fitness facilities and provides e-commerce services. The Platform offers the following key features:

• Gym Bookings and Memberships: Users can search for and book access to affiliated gyms (Gym Partners) on a pay-per-session basis or under various subscription plans (monthly, quarterly, half-yearly, or annual). ALTGYM provides scheduling tools, booking calendars, and membership management.
• Subscription Management: Users may subscribe to recurring membership plans for access to partner gyms. The pricing model includes monthly, quarterly, half-yearly and annual subscription fees. Subscription plans auto-renew until canceled. Users can view and manage their active plans in their Account.
• Product Sales (Supplements & Apparel): ALTGYM facilitates the sale of health and fitness products. Through the Platform, Users may purchase nutritional supplements, workout apparel, and related merchandise. Products are sold at listed prices, subject to availability. Delivery or pickup options will be as indicated at checkout.
• Partner Network Access: The Platform provides access to a network of third-party gyms and fitness centers. Users can browse details of each Gym Partner (location, amenities, schedules) and book sessions accordingly. ALTGYM serves as an intermediary to connect Users with these facilities.
• Ancillary Services: Other supportive services (e.g., fitness tips, promotional offers, loyalty points) may be provided as features of the Platform.

All Services described above are governed by these Terms. For clarity, ALTGYM itself is not a gym operator or a health product manufacturer; rather, we facilitate transactions and bookings between Users and third-party providers. The specific services at each partner gym such as personal training, classes, or facility usage are provided by that gym under its own terms, rules, and staff; ALTGYM merely enables the booking or introduction. Similarly, products sold supplements and apparel may be provided by third-party vendors through the Platform's marketplace, and we do not manufacture those products.

ALTGYM reserves the right to introduce new features or products in the future. All current features are included in the scope of these Terms. We may integrate third-party tools or content payment gateways, advertisement, analytics, but such third-party services are also subject to their own terms and are used by us to improve the Services.

Any refunds will be issued to the original payment method within a reasonable period. ALTGYM will not be responsible for any banking or currency conversion fees that may apply to refunds. In the event of cancellation, ALTGYM may charge reasonable cancellation fees or administrative charges as permitted by law and disclosed in our policies.

By purchasing or subscribing, you represent that you have the legal right to use the chosen payment method. Any fraudulent or unauthorized use of payment methods will be treated as a breach of these Terms, and ALTGYM may recover any losses from you or law enforcement.

You agree to use the Platform and Services only for lawful purposes and in accordance with all applicable laws, rules, and regulations. Certain activities are expressly prohibited. Specifically, you must not:

• Violate Law or Rights: Engage in any activity that violates Indian law or the law of your jurisdiction, including but not limited to fraud, harassment, stalking, intimidation, defamation, or infringement of intellectual property or privacy rights of others.
• Abuse or Harass: Abuse, harass, threaten, or use obscene language toward ALTGYM personnel, other Users, Gym Partners, or any third party. This includes any form of cyberbullying, hate speech, or defamatory remarks.
• Fraudulent Activities: Use false or misleading information in any aspect of the Services including your profile, payments, or booking details, or make reservations without intent to actually attend false bookings. Any attempt to defraud ALTGYM or our partners e.g., credit card fraud, chargebacks without cause will result in immediate suspension and may be reported to authorities.
• Unauthorized Access: Share your ALTGYM Account, login credentials, or access tokens with others. You may not transfer your Account to another person or allow multiple people to use one Account. Each Account is for individual use only.
• Interfere with Others: Disrupt or interfere with the use of the Services by others, including other Users or Gym Partners. This includes attempting to strain, spam, flood, or overload our systems.
• Violating Partner Rules: Act in violation of any rules, regulations or posted policies of any Gym Partner you visit. Each Gym Partner may have additional policies (e.g. dress code, non-flash photography, age restrictions). You must comply with those gym-specific rules while on their premises.
• Platform Misuse: Copy, reproduce, modify, reverse engineer, disassemble, or attempt to extract the source code of the Platform or any part of the Services. You may not use the Services to crawl or scrape data, or engage in any activity that interferes with the functioning of the Platform (e.g. hacking, using viruses or denial-of-service attacks).
• Non-Commercial Use: Use the Platform in any way that suggests an association with ALTGYM without our prior written consent, or use the Platform to post advertisements, solicitations, or commercial ventures beyond the scope of these Terms.

ALTGYM reserves the right to investigate and determine, at its sole discretion, whether there has been a breach of this Section. If we determine that you have engaged in prohibited conduct, we may take appropriate actions, including immediately suspending or terminating your Account, blocking your access to the Services, and/or pursuing legal action. In the event of any violation of these Terms by a User, ALTGYM may seek all remedies available at law or in equity. You agree that ALTGYM has the right but not the obligation to remove or disable access to any content that violates these Terms.

ALTGYM's Platform connects Users with third-party fitness facilities Gym Partners but does not itself operate any gyms. Each Gym Partner is an independent entity, and ALTGYM is not responsible for the operations, policies, or services of any Gym Partner. You acknowledge that ALTGYM merely provides a platform for scheduling and payment; the actual gym sessions, equipment, training, and support are provided by the Gym Partners.

• Intermediary Role: ALTGYM acts solely as an intermediary between Users and Gym Partners. We do not employ or supervise any gym's employees or trainers.
• Service Issues: If a Gym Partner denies you access or fails to provide the booked service, ALTGYM will use reasonable efforts to assist.
• Partner Changes: If a Gym Partner discontinues its affiliation with ALTGYM while you hold an active subscription, ALTGYM will endeavor to provide you with access to a comparable alternative gym in our network.
• No Liability for Gyms: ALTGYM assumes no liability for the actions or omissions of any Gym Partner.

In compliance with the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 under the IT Act, ALTGYM has designated a Grievance Officer to address user complaints. You may submit complaints or feedback through the following channels:

Upon receipt of a complaint, ALTGYM will acknowledge it within 24 hours and use reasonable efforts to resolve it within 15 days from receipt. These timelines are subject to applicable laws. If you are not satisfied with the resolution, you may escalate the matter as permitted by law.
